Terms and Conditions of Use Agreement between American Mini Pig Association (“AMPA”) and User
- Introduction
Please read this Terms and Conditions of Use Agreement between AMPA and User (“Agreement”) carefully as well as AMPA’s Privacy Policy which is incorporated herein by reference. Your use of AMPA’s website (“Site”) constitutes your binding acceptance of the terms in this Agreement (“Terms”), including any modifications at AMPA’s sole discretion. If you do not agree to these Terms and the Privacy Policy, you must immediately terminate use of this Site.
- The Site Does Not Provide Medical Advice
The contents of this Site, such as text, graphics, images, information obtained and other material contained on this Site (“Content”) are for educational and informational purposes only. Extract, harvest, or mine data or otherwise collect information about others without their consent, including without limitation information about AMPA, its directors, officers, employees, members, agents, or volunteers;

Promote spam or forward unauthorized information including but not limited to surveys, contests, solicitations, or business schemes;
Use the Site in any way that is or may be damaging to the Site or AMPA;
Use the Site in any way that impacts other users’ access to the Site;
Violate any applicable laws or regulations.
- AMPA has no obligation to monitor the Site Services. AMPA reserves the right to refuse, move, or remove, at any time for any reason and, in AMPA’s sole discretion, Content posted or uploaded by you to any AMPA Site.
- AMPA disclaims responsibility and liability for the Content and opinions expressed by others on the Site including, but not limited to, Content or opinions by its users and other third parties. Views expressed using the Site Services are not necessarily those of AMPA.
- You hereby indemnify AMPA, its directors, officers, employees, agents, volunteers from and against any and all liabilities, causes of action, demands, damages, expenses and costs arising out of or in any way related to your failure to properly use the Site or breach of any provisions of this Agreement.
- User Content
By using or uploading any User Content, you grant AMPA a non-exclusive, perpetual, worldwide, irrevocable, royalty-free, sub-licensable license to use, reproduce, adapt, publish, translate, copy, and distribute the User Content in any form or manner. “User Content” means any audio, video, text, images, or other material or information a user of the Site chooses to display on the Site.
You agree to indemnify and hold harmless AMPA, its directors, officers, employees, agents, and volunteers from any and all liability, damages or expenses whatsoever due, directly or indirectly, to any causes of action arising out of the User Content posted by you.
You warrant and represent that you either own or otherwise control all of the rights to the User Content, including without limitation, all the rights necessary for you to provide, post, upload, input, or submit the material, or that your use of the material is a fair use as defined by applicable law.
You acknowledge that no compensation will be paid with respect to the use of your User Content, as provided herein.
- Linked Sites
The Site may contain links to other websites operated by third parties. These links are provided as a convenience to users only and the inclusion of any link does not imply endorsement by AMPA of such site or any association with the third party site owner or operator. AMPA expressly disclaims any responsibility or liability for the content of any other site.
- Third Party Sites and Services
Any agreements, engagements, business dealings with third party sites or services found on or through the Site are solely between you and the third party. AMPA does not make any representations or warranties with respect to any goods or services that may be obtained from such third parties. You agree that AMPA will have no liability for any loss or damage of any kind incurred as a result of any activities you undertake in connection with the use of or reliance on any content, goods, services, information or other materials available or through such third parties on the Site.
- Registration and Password
You are solely responsible for ensuring the proper use of passwords and accounts granting access to certain portions of the Site and that no unauthorized person shall have access to your password and account. You agree to provide AMPA with accurate, complete, and updated registration and account information and failure to do so shall constitute a breach of this Agreement, which may result in immediate termination of your access to the Site.
- Violation of Terms of this Agreement
Any violation of the terms of this Agreement by you allows AMPA, in its sole discretion and without notice, to block and/or terminate your access to the Site and take any other action necessary including making reports to applicable government or other authorities.
You are liable for any and all violation of any of the terms of this Agreement. AMPA shall be entitled to any and all remedies available in law or equity. You acknowledge that because breach by you of any of the terms and obligations under this Agreement could cause irreparable harm to AMPA for which damages would be an inadequate remedy, if any such breach occurs or is threatened, AMPA will be entitled to an injunction, a restraining order, or any other equitable remedy, in each case without posting a bond or other security and without proof of actual damages.
If AMPA takes legal action against you as a result of your violation of the terms of this Agreement, AMPA will be entitled to recover and you agree to pay all reasonable attorneys’ fees, costs, and expenses of such action in addition to any other relief granted to AMPA. You agree that AMPA will not be liable to you or any third-party for termination of your access to the Site as a result of your violation of the terms of this Agreement.
- Liability Disclaimer
AMPA DOES NOT WARRANT THAT THE SITE, CONTENT AND ANY RELATED MATERIALS WILL BE ERROR FREE, UNINTERRUPTED, FREE FROM VIR– USES OR OTHER HARMFUL COMPONENTS OR DEFECTS.
AMPA MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS OR ACCURACY OF THE CONTENT, INFORMATION, SERVICES, PRODUCTS, SOFTWARE, AND ANY RELATED MATERIALS CONTAINED ON THE SITE FOR ANY PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH CONTENT, INFORMATION, SERVICES, PRODUCTS, SOFTWARE, AND ANY RELATED MATERIALS CONTAINED ON THE SITE ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, ACCURACY, FITNESS FOR ANY PARTICULAR PURPOSE, OR TITLE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMPA BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF — USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE — USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO — USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY CONTENT, INFORMATION, SERVICES, PRODUCTS, SOFTWARE, AND RELATED MATERIALS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE — USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF AMPA HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.
- Choice of Law; Venue
The Site is controlled, operated, and administered within the United States of America. AMPA makes no representation or warranty about the Site’s appropriate and available use outside of the United States of America. If you use the Site and access it from outside of the United States of America you are solely responsible for compliance with all such local laws. This Agreement is governed by the laws of the State of Washington, United States of America, without reference to conflicts of laws and without regard to the location of execution or performance of this Agreement. You exclusively consent and submit to the courts in King County, Washington and the interpretation of laws by the State of Washington.
- Severability
If, for any reason, a court of competent jurisdiction finally determines any provision of these Terms, our Privacy Policy, or any portion thereof to be unenforceable, such provision shall be enforced to the maximum extent permissible so as to give the intended effect thereof, and the remainder of these Terms and Privacy Policy shall continue in full force and effect.
- Entire Agreement
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and AMPA with respect to the Site, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and AMPA with respect to the Site.
